Terms of Service

Submit a Site accepts and submits URLs for inclusion in the web database of various search engines, such as Google and MSN Search. By utilising this service, you are forming a contract with Submit a Site and the search engine and will be bound by the terms and conditions of each.

1. Submit a Site shall not be responsible for URLs dropped or excluded by a search engine for any reason.
2. The terms and conditions required by each search engine are outside the control of Submit a Site. Submit a Site shall have no liability to you relating to your failure to comply with such terms and conditions.

3. You grant Submit a Site the right to use any or all parts of the listings and site information you provide to publicly perform, display and distribute it; copy and manipulate it as reasonably necessary for such performance, display or distribution; modify it; and archive and store it. You also grant Submit a Site a royalty free, world-wide right and license to access, index, cache, and display the web sites to which your listings link, or any portion thereof, including by any automated means such as web spiders or crawlers.
4. Submit a Site randomly checks URLs scheduled for submission. Your URL will not be included if it:
   1. Is illegal;
   2. Infringes the rights of a third party;
   3. Submit a Site deems that the content for any reason is inappropriate including but not withstanding:
      • adult or erotic oriented content
      • pornographic or adult advertising
      • racist content
      • promotes/disseminates illegal activities
      • terrorist content
      • occult or related material
      • defamatory content
   4. Submit a Site receives a notice of an act of copyright infringement in compliance with the notice requirements of the Digital Millennium Copyright Act of 1998; and
   5. In response to a court order or other judicial or governmental request or action.
   6. In these cases you will not be entitled to a refund.
5. Submit a Site shall not be responsible for delays or failure of performance resulting from Internet Service Provider delivery problems or failure, or any communication or delivery problems associated with Client's receipt of the Account Service data. Submit a Site shall not be responsible for acts or causes beyond their control, including but not limited to: acts of God, strikes, lockouts, communications line or equipment failures, power failures, earthquakes, or other disasters.
6. Submit a Site does not represent or warrant that Customers' URLs will achieve a favorable position, or any position, within a particular search engine.
7. Submit a Site does not warrant or represent that the use or the results of the use of the materials available through the Submit a Site Services or from third parties will be correct, accurate, timely, reliable or otherwise.
8. You expressly agree that use of the Submit a Site Services provided hereunder is at your sole risk. These Services are provided on an "as is" and "as available" basis. Submit a Site expressly disclaims all warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose or non-infringement.
9. Submit a Site does not guarantee that Customers' URLs will be included in a search engine, "Free For All Links" web site or directory as a result of the URL being in violation of third party terms and conditions or at the discretion of the search engine. In these cases you will not be entitled to a refund.
10. Notwithstanding the security precautions taken against disclosure of information, there are certain conditions that exist on the Internet generally which are outside Submit a Site's control and could result in a breach of security. Accordingly, Submit a Site cannot guarantee that your "Account Service" data information will be free from corruption or piracy. You hereby expressly waive any claim against Submit a Site arising out of the loss of data through corruption, piracy, breach of security or for any other reason that is not based on intentional or grossly negligent actions of Submit a Site.
11. To the maximum extent allowed by law, Submit a Site and any of their parents, members, subsidiaries, affiliates, service providers, licensors, officers, directors or employees shall not be liable for any direct, indirect, special, incidental or consequential damages (no matter how they arose, including negligence), or for interrupted communications, lost data or lost profits, arising out of or in connection with the Services provided hereunder. Further, Submit a Site will not have any liability for any losses arising because the Submit a Site Services are not operational or accessible. This section does not limit liability for bodily injury of a person. Some states do not allow limitations on incidental or consequential damages, so the above limitations may not apply in certain circumstances.
